General Standard Terms and Conditions of PaperC Innovation GmbH for use of the “PaperC” Internet Service “PaperC.com”

Preliminary note:

 

Primacy of Version of General Terms and Conditions:

 

Please understand that PaperC is a company with place of business in Germany. Please note that the wording of the terms and conditions are originally stated in German language. The English version of the terms and conditions is based on the German version and on the applicable German law. Due to this it may be the case that some wording in the German version could not be translated one-to-one into the English wording. Please note therefore that in doubt the wording of the provisions in the German version of the general terms and conditions shall have priority.

 

1. Area of application

 

The following General Standard Terms and Conditions (“Terms & Conditions” in the following) apply between PaperC Innovation GmbH (“PaperC” in the following), and every customer of PaperC (referred to individually or collectively as “User” or “Users” in the following) to all chargeable or free services that are offered via the internet platform at the www.paperc.com domain (“Digital Distribution Service”” in the following). Services for which a charge is made include in particular accessing – in full or in part – works of specialist literature in a digitized and copy-proof version (“subject matter of license” or “Content” in the following) to the extent that this is offered by the Digital Distribution Service and pursuant to these Terms & Conditions.

 

PaperC reserves the right to modify or alter the Terms & Conditions at any time with effect for the future. Changes to the Terms & Conditions do not affect rights of use of Content already granted to Users pursuant to these Terms & Conditions. PaperC will draw attention to any changes in the Terms & Conditions at an appropriate place in the Digital Distribution Service or by an e-mail to registered users. The User will accept the new version of the Terms & Conditions by his log-in following such notification.

 

 

2. Necessary personal and technical prerequisites of the User

 

2.1.

Persons wanting to use the part of the Digital Distribution Service for which a charge is made must be aged 18 or over. Use by a minor shall only be permitted under the supervision of a parent or legal guardian. Services for which a charge is made may in all cases only be ordered by a parent or legal guardian. No entitlement to registration and membership of PaperC exists.

 

2.2.

The prerequisite for use of the chargeable part of the Digital Distribution Service is that the User registers the required data (personal data including e-mail address), data on payment mode (credit card details or online direct debit authorisation) and sets up his own user account with the Digital Distribution Service. This will be done by the User himself by registration of his User name and a password (registration in the following). Successful registration will be confirmed by PaperC by e-mail for the purpose of activating the user account (“activating e-mail” in the following); the User for his part must confirm this e-mail by clicking on one of the links sent with the activating e-mail. The data will be processed electronically by PaperC. Registration will only be valid if the data submitted is correct and complete. The User gives PaperC an undertaking to keep his registration data up to date at all times and to notify the Digital Distribution Service of any and all changes without delay. The User is obliged to keep his log-ins secret. Passing on log-ins to a third party or their use by a third party is not permitted. PaperC will not accept any liability for damage arising from unauthorised use of the log-ins. The User shall be liable for any damages arising from any misuse of his log-ins. The User must notify PaperC immediately about any misuse or loss of his log-ins. The User’s liability for said misuse of log-ins shall not end until he has successfully notified PaperC of such case and PaperC has invalidated the log-ins.

With regard to personal data please read the notes in the data confidentiality declaration below.

 

2.3

The Digital Distribution Service can only be used by end consumers. Thus, no bills for commercial purposes will be made out. Business enquiries will be answered at support@paperc.com. An invoice may be requested at the very same e-mail-address.

 

3. Technical system requirements for the use of the Digital Distribution Service

 

3.1

In order to use the Digital Distribution Service, the User needs certain system requirements and must have the necessary online feature that makes access to the Digital Distribution Service technically possible. The ensuing connection costs do not form part of the contract. Use of the Digital Distribution Service presupposes the use of suitable computer hardware and software.

 

3.2

In order to use the Digital Distribution Service, the User’s device must meet specific hardware and software requirements.

 

The User must in particular

 

-use an “iPhone”, “iPad” or “iPod-Touch” or a device comparable to those including iOS Version > 5.0, an Android end device with Android version >4.0.1 or a computer (PC or Mac), on which one of the following Browsers run in the consecutive updated version, namely

-Google Chrome, Safari or Firefox, as well as

-maintain and provide for the PaperC App on his end device with integrated WebSQL or IndexedDB Browser data file at least 50 MB memory capacity.

 

3.3

The use (from the moment available, April 2013 on) of the feature of Digital Distribution Service to access Content not only online, meaning while connected to the internet, but to access any Content according to these Terms & Conditions offline as well, requires an end device with integrated browser that supports the feature “WebSQL-data file” or “IndexedDB- data file”. In case the end device should not meet the said requirements any Content can only be accessed by Users online. Users are strongly advised to make sure, that their end device meets the system requirements to be capable to save any Content data licensed for offline-use. Please note for further details regarding the feature “offline synchronization” modus in particular the provisions in fig. 4.2 and 5. hereunder.

 

3.4

Use of the Online Service can be dependent upon the use of cookies for it to become operational and for access authorisation to be checked. If the browser settings of the User do not permit this, registration with or use of the Online Service may not be possible or only possible with substantial restrictions.

 

 

4. Chargeable and free use

 

After valid registration, the User is authorised to access digitized Content – as a whole ebook or – if applicable - as one or more chapters of an ebook – from the Digital Distribution Service offering made available for demand and use pursuant to these Terms & Conditions. Acquisition of access and use can take the following forms:

 

4.1

The digital Content made available by the Digital Distribution Service “paperc.com” can be received at the prices shown by the Digital Distribution Service plus VAT at the statutory rate pursuant to the Terms & Conditions and as stated in the service offerings at “paperc.com”. The User can order to get full access to any Content by clicking the “buy now” or “kaufen” button for the respective offering for „purchase“ of digital Content or – as applicable – by clicking the the „order now for rent“-button in case of the respective offering for access to any Content for a limited set period of time (rental model) in the Digital Distribution Service “paperc.com” and successfully passing the order procedure. After the first click of the “buy” or “kaufen” button or – as applicable – the „order now for rent“- button, the User will be immediately asked in the user interface of the service to confirm the order in the next step by clicking the “buy now” or “kaufen” button or – as applicable – the „order now for rent“- button, once again. With such confirmation by the User the agreement for the chosen Content between User and PaperC comes into effect..

 

Depending on the User’s payment information provided to PaperC via the user interface in “Settings” or “Einstellungen” in the Digital Distribution Service at “paperc.com”, the payment due will automatically debited from the User’s credit card or by payment made by direct debit from the User’s bank account. Please note that according to statutory law the nature of the contract (purchasing access to Content and the right to make contractual use of it) does not give the User a right to withdraw from an agreement which once has been concluded according to these Terms & Conditions.

 

4.2

Upon PaperC’s receipt of User’s payment of Content ordered hereunder in case of purchased digital Content the logged-in User can access and use the available Content unlimited in time for reading online by using the PaperC App provided for use within the Digital Distribution Service at “paperc.com”. Starting April 2013 PaperC grants to Users furthermore the right to access and use paid Content through the Digital Distribution Service at any time and for an unlimited period of time offline in terms of so-called offline synchronization. That means that the User can chose to digitally synchronize paid Content with his end device. Therefore the digital data of Content can be saved in the technically suitable browser data file of User’s end device, which allows the User to use the Content on his device without an active connection to the internet. Therefore no download of Content as an electronic data file is necessary and is not available.

 

Please note that the procedure of synchronisation of Content data with the User’s end device does require sufficient memory capacity in the integrated browser data file. The user must make sure that he has got sufficient memory capacity on his end device or must delete existing data before he actually can order new Content data for offline synchronisation. Please note that PaperC has got no insight and no influence on the memory capacity of the User’s end device browser data files. Any Content ordered and paid for by the User may therefore be deleted from time to time on his end device but can on his demand be ordered for new synchronisation at any time and for the entire period of granted rights (see section 5. hereunder) without further costs. The status of the memory capacity of the User’s browser data file does not have any influence on the features of online use.

The same as aforesaid in section 4.2 shall apply for offerings to access available digital Content for a preset limited period of time on a rental basis, though the User’s non-exclusive and non-transferable simple right to use and access the ordered Content paid for shall automatically cease with the date of expiration of the respective rental period.

 

4.3

A User can use the Digital Distribution Service in restricted mode of operation free of charge for the purpose of searching the Digital Distribution Service for the availability of ebook titles. The service allows Users – provided PaperC is authorized by its publishing partners to offer such a feature - to read a limited portion of an ebook on trial free of charge. The limitation of trial reading is – if applicable – shown in the service at “paperc.com” in connection with an Content offering.

 

4.4

PaperC has the right to change the prices of Content made available via the Digital Distribution Service with future effect. PaperC will give notification of price changes in the most recent version of the Terms & Conditions via the Digital Distribution Service.

 

4.5

PaperC accepts payment by credit card and payment by direct debit banking aswell as using the payment provider PayPal Inc. If payment by direct debit is chosen, the User shall authorise PaperC to collect the charges due for orders placed from his bank account named by means of direct debit.

 

5. The scope of allowed usages

 

5.1

The entire Digital Distribution Service offering is protected by copyright, trademark law and by further laws. This applies not only to the subject matter of the license, the data base, data base works but also to elements of the Digital Distribution Service protected by copyright that are contained therein.

 

5.2

Uses are only permitted for personal use; this includes use as part of the everyday professional activities of the User or for his own academic/scientific work.

 

5.3

Unless otherwise provided for in the following for users of the chargeable Digital Distribution Service offering, the User of the Digital Distribution Service may create a temporary local digital copy of the specific offering of the Digital Distribution Service in terms of trial reading and subject to the set limitations of the trial reading offering. Such copy is in any case strictly only admitted temporarily on the PC or comparable computer hardware of the User and constitutes an integral part of an electronic process (caching) and is only for the purpose of use of the free features of the Digital Distribution Service. Creating screenshots of Content obtained from the Digital Distribution Service and displayed on the User’s monitor is explicitly not permitted.

 

5.4

A non-exclusive and non-transferable right to access and for use of paid Content provided by and through the Digital Distribution Service according to these Terms & Conditions will be granted to the User of the chargeable Digital Distribution Service offering. From April 2013 on the User is entitled to access on his demand any available and paid Content by way of digitally synchronization of Content with the browser data file integrated in his end device and to save such data for his offline use at an time and for an unlimited period of time. In case of usage on the base of the rental model, the User’s right to use and access the respective digital Content is limited in time to the period of time, as it is paid for and subject to the rental contract between Paperc and the User. The User is explicitly prohibited from passing such copies on to any third party either in their entirety or in part, in particular this is prohibited in the form of sale, renting, leasing, rental or similar either commercially or for business purposes in any other form.

 

5.5

The User may not rework or adapt the Content of the subject matter of the license either in full or in part unless this is necessary for the contractually agreed use of the subject matter of the license or is explicitly permitted.

 

5.6

The User may not copy or seek to copy or “rip” any Content from the Digital Distribution Service or any part of the Digital Distribution Service (including, without limitation, the PaperC widget) The User may not embed or otherwise exploit the PaperC widget for commercial gain (which includes, for example and without limitation, selling advertising on another site or otherwise monetising any element of another site which contains the PaperC widget)

 

5.7

The User may not use the subject matter of the license to build up a systematic collection and/or use it in a retrieval system with the help of retrieval software.

 

5.8

No author details, copyright notices, publishers notices, references to identifying features (in particular marks and protected identifying features), logos as well as references to liability, reserved rights etc. may be removed, altered or disabled technically or manually in any other way.

 

5.9

Granting rights of use in respect of the subject matter of the license that forms part of the chargeable Digital Distribution Service offering is subject to the condition of payment in full by the User on the order conditions set out in these Terms & Conditions and in the service at “paperc.com”.

 

 

6. Usage of “Creative Commons” License Content from the Digital Distribution Service offering

 

6.1

PaperC will also make available Content in the free section of the Digital Distribution Service that is published under what is known as a Creative Commons License (“CC License” in the following) and for which special conditions of use apply generally accessible to each User. Content under CC License is indicated by corresponding pictograms as depicted in the following under Section 6.3 of the Terms & Conditions. The conditions of use pursuant to Section 5. of the Terms & Conditions do not apply to such Content.

 

The conditions of use pursuant to Section 5 of the Terms & Conditions apply to all Content not marked in the above way without restriction.

 

6.2

The conditions of use of Content published under CC License correspond to the provisions of the “Creative Commons License Deed”. The valid CC License is accessible using the link http:// http://creativecommons.org/about.. The conditions of use of all Digital Distribution Service offerings subject to the CC License are those of the CC License applicable at the time in question; they form an integral part of these Terms & Conditions.

 

6.3

The User may only use Content under CC License in the way permitted by the author of the Content published. The scope of authorised use arises from the specific CC License under which the author has published Content. At present the following forms of CC License exist:

 

6.3.1

Naming author - 3.0 Germany: Under this license the User may a) duplicate, distribute Content and make it generally accessible, b) modify or adapt Content on the condition that the author is named in the way specified by him.

 

6.3.2

Naming author + no commercial use - 3.0 Germany: Under this license the User may a) duplicate, distribute Content and make it generally accessible, b) modify or adapt Content on the condition that the author is named in the way specified by him and the Content is not used for commercial purposes.

 

6.3.3

Naming author + no commercial use + no adaptation - 3.0 Germany: Under this license the User may duplicate, distribute Content and make it generally accessible on the condition that a) the author is named in the way specified by him, b) Content is not used for commercial purposes and c) no adaptation takes place.

 

6.3.4

Naming author + no commercial use + passing on of Content, also in modified form, only with the same conditions - 3.0 Germany: Under this license the User may duplicate, distribute Content and make it generally accessible on the condition that a) the author is named in the way specified by him, b) Content is not used for commercial purposes and c) Content is passed on on the same conditions.

 

6.3.5

Naming author + no adaptation - 3.0 Germany: Under this license the User may duplicate, distribute Content and make it generally accessible on the condition that a) the author is named in the way specified by him and b) no adaptation takes place.

 

6.3.6

Naming author + passing on of Content, also in modified form, only with the same conditions - 3.0 Germany: Under this license the User may duplicate, distribute Content and make it generally accessible on the condition that a) the author is named in the way specified by him, and b) Content is passed on on the same conditions.

 

7. Availability of the Digital Distribution Service, warranties

 

7.1

PaperC will make every effort to make the Digital Distribution Service available 24 hours a day and seven days a week. However, no entitlement to the permanent availability of the Digital Distribution Service exists, except for such Content paid for by the User to these terms and conditions..

 

PaperC does not give any guarantee

 

- that Content as for example that that is available online via the Digital Distribution Service at the time of conclusion of the contract on the use of the Digital Distribution Service pursuant to these Terms & Conditions will also be fully or partly available online at later times. This does not apply to any Content paid for by the User, provided the User did save the data of Content by way of offline synchronization (from April 2013) with his end device if applicable.

- that such Content ordered that the User has filed in the “My library” feature of the Digital Distribution Service will be permanently available for retrieval by the User any number of times. This does not apply to any Content paid for and/or ordered on a rental basis.

 

PaperC only guarantees availability insofar as the specific Content selected and paid for by the User is actually available at the time of the order.

 

7.2

In view of the provisions 7. 1. hereinabove PaperC reserves the right to alter the Content available via the Digital Distribution Service at any time and to remove Content – in full or in part – from the offering without notice.

 

7.3

In particular PaperC does not guarantee availability

 

-should the Digital Distribution Service not be available due to disruptions arising from faults in the data transfer system or for reasons under the control of a third party;

-in cases of force majeure, natural disasters, strike, war or uprisings;

-should the Digital Distribution Service not be available due to the fact that the User does not have the necessary technical requirements either in full or in part;

-should the Digital Distribution Service not be available due to maintenance work thereto.

 

7.4

PaperC does not guarantee that the hardware and software of the User will be suited to the uses of the Content that have been contractually agreed irrespective of whether they are in conformity with the recommended system requirements or not.

 

8. Liability

 

8.1

PaperC accepts liability

 

-in cases of intent or gross negligence, also on the part of its representatives or vicarious agents;

-in cases of slight negligence only if it has infringed an essential duty, restricted to damage that would be typical for the subject matter of the contract; no liability will be accepted in cases of indirect or unforeseeable damage or claims by third parties in cases of slight negligence;

-in full arising from a warranty.

 

8.2

PaperC will not accept liability in any other respects.

 

8.3

Liability of PaperC for personal injury (loss of life, physical injury or damage to health) and liability under the Produkthaftungsgesetz shall not be affected by the aforesaid.

 

9. Use of data

 

PaperC will process the data of the User electronically. Here, PaperC will comply with the data protection provisions of statutory law. The User’s data will only be used by PaperC for the purpose of making it possible for the User to obtain and use the Content provided by the Digital Distribution Service in accordance with these Terms & Conditions. Further, this data will be stored, processed and used to make the Digital Distribution Service offering available including the display of user-defined Content and advertising, for statistics, for development of new Digital Distribution Service offerings. Further information on the subject of use of personal data can be found here below.

 

 

10. Third-party claims and indemnification

 

The rights of the User are subject to the condition subsequent of infringement by the User of its obligations pursuant to these Terms & Conditions. In the case of infringement by the User of authorised use regulated and restricted in these Terms & Conditions, the User shall indemnify PaperC from all third-party claims, in particular claims for damages, lawyers fees and the costs of litigation.

 

11. User contributions, comments, reviews, notes (“Contributions” in the following) liability for links

 

11.1

PaperC permits the User to use the blog section of the Digital Distribution Service during his period of registered membership. The User permits PaperC to make the Contributions posted generally available worldwide, to duplicate and disseminate it and make it available to third parties for corresponding uses via www.paperc.com or, if applicable, other web domains or media

 

11.2

The Digital Distribution Service is entirely intended for personal use. Contributions with commercial character (such as offers of products or services) in the blog section will be deleted immediately. The right to block and delete the user account of the user that posted such content is reserved.

 

11.3

PaperC also has the right to carry out promotion activities in the environment of Contributions made generally available and using such Contributions. The User explicitly gives his consent to this.

 

11.4

The User permits PaperC to adapt the Coontributions posted, in particular to modify it to comply with the format required for use or improve the presentation quality and also to link it to other content or to brand the content.

 

11.5

The Digital Distribution Service has an open community. It is a condition of the purpose of the community that all Contributions, including tags posted on the Digital Distribution Service that users provide to the public in the framework of the Digital Distribution Service as well as notices published and comments, is freely available to third parties and in particular can be used by third parties for their own purposes. The User can however decide upon whether he wants to make his own Contributions available to the public or not by using the setting options in the user interface provided to the User with the PaperC App. The User grants PaperC the right to grant sub-licenses and transfer the rights of use in such Contributions that were granted. However, the User remains responsible and liable for the Contributions that it has posted. PaperC does not monitor or otherwise control the Contributions that the User has posted but reserves the right to monitor, control, modify, decline or delete any of such content at its sole discretion. PaperC has the right to transfer the contract/contracts with the User that was/were concluded in accordance with these Terms & Conditions to a third party in whole or in part.

 

11.6

The User guarantees that he owns all of the rights in the Contributions posted that are required for the aforesaid uses and/or that he may make dispositions regarding these rights and that use via the Digital Distribution Service as well as in other media and form of exploitation will not infringe any rights of third-party rights of any kind or any provisions of statutory law. The User is solely responsible for any of its Contributions that it has posted and is obliged to hold PaperC free and harmless from any claims by third parties in connection with such content.

 

11.7

PaperC will not accept liability for the content of links to the websites of third parties. The content of third-party websites will not be monitored. PaperC has no influence on the content of linked websites,

 

11.8

PaperC reserves furthermore the right to delete links posted by users if PaperC receives information that they lead to sites that contain inadmissible content pursuant to Section 11 of these Terms & Conditions.

 

11.9

The User consents to third parties providing links or references to the content he has posted on PaperC. Providing a link to www.paperc.com for commercial purposes is explicitly prohibited.

 

12. Repeat of Users consent pursuant to the Terms & Conditions

 

The following consent is given to PaperC by the User and PaperC hereby notifies, that it has recorded such declarations of consent. Statutory media law requires PaperC to provide access on the Users demand to any declarations of consent given herein. The User may withdraw any of his declarations of consent provided to PaperC herein at any time with future effect.

 

Consent to receive advertising e-mails:

 

“I want to receive information about the offerings of PaperC and its partners.”

 

(I acknowledge that I can unsubscribe at any time).

 

13. Termination of membership of PaperC

 

13.1

The User can terminate his membership created by having a user account at PaperC at any time. The User acknowledges that any access to Content already paid for requires an active User account with the Digital Distribution Service at “paperc.com”.

13.2

PaperC has the right to block a user’s access to the Digital Distribution Service without prior notice and/or to delete a user account, thereby terminating membership, if the user in question infringes the Terms & Conditions as stated in section 5. herein above by way of violating the copyrights of the copyright owners of any Content.

 

13.3

In any case of termination of membership, PaperC has the right to delete Contributions posted by the User fully or partly at its discretion. The User has no claim to surrender of the Contributions he has posted or to its return in any other way. All user data stored will be deleted when membership is terminated. Regarding the use of all personal data reference is made to the [button “Information on data protection”].

 

14. Final provisions

 

13.1

Ousting the CISG, the law of the Federal Republic of Germany shall apply to the legal relations between the User and PaperC.

 

13.2

PaperC has the right to transfer registration of the User with the PaperC as well as all contracts concluded with the User to a third party in full or in part with the consent of the User. Consent is deemed to have been given if the User does not object in writing within one month of such notification of the User by PaperC. Notification can be in the form of an e-mail.

 

13.3

The Digital Distribution Service contains links to third-party websites with Content that PaperC cannot check or influence. PaperC explicitly does not make the Content of linked websites its own and does not accept any liability for its Content.

 

13.4

The place of performance of all contractual obligations is the registered place of office of PaperC.

 

13.5

Should any provision of these Terms & Conditions be without legal effect, this shall not affect the validity of the remaining provisions of the Terms & Conditions.

Notes on data protection

 

Acquisition and storage of your data; Users consent

 

You can also use parts of the Digital Distribution Service of PaperC without registration or a log-in. Your personal data will be processed by PaperC if you request access to chargeable content. If not otherwise stated hereunder your personal data will be processed for the purpose of handling the order, administration of search requests via the Digital Distribution Service, to obtain e-mail communications, administration of PaperC subscriptions and, in an anonymous form, for our own statistics. In particular, this data includes your name and postal address, your e-mail address, your order details, your IP address, URL and data on payment and any other information required to carry out the order. Upon registration and log-in you may post more personal information via your user profile. For purposes of this notes on data protection, all information provided by you during your initial registration over and to the Digital Distribution Service and during your creation of a user profile, including, for example, your real name, e-mail address, postal address and other location information, your age, your gender and certain other demographic information or information that may enable online or offline contact with you will automatically become public information, which can be seen by others.

We use a technology that allows PaperC and its affiliated entities and third party contractors to create and maintain a collection of your personal usages of the Digital Distribution Service. This is accomplished by monitoring and recording your data as regards your activity on the Digital Distribution Service i.e. which titles of content you search for, which content you chose for download or chose to let display to you, content and titles you skip, your recensions and reviews of contents and your recommendations of titles and contents to one or multiple other user. All of the information that is generated by your activity on the Digital Distribution Service is fed back into our technology in order to fine tune your profile so that PaperC can finetune its services to your needs and its offers to users including you. PaperC makes some of this information available to third parties, mainly publishers, to undertake analyses of market and development of new products and services.

In case you should decide to terminate your user account and your registration to the Digital Distribution Service or you decide to remove information from your profile, copies of that information may remain viewable elsewhere to the extent it has been shared with others, it was otherwise distributed by PaperC or through the Digital Distribution Service in accordance with the users consent provided to PaperC by accepting the General Terms and Conditions and notes on data protection, or it was copied, stored, and re-distributed by other users. Any information posted by you and shared with others can not be deleted from the system but from the public view. In case you delete your account, the data stored about your reading progress will still remain with us anonymously.

PaperC reserves the right to create and to include further features, functions and offers in and via the Digital Distribution Service which may not be available for the user yet. The user acknowledges, that all personal data and non-personal information according to these notes on data protection shall apply accordingly.

PaperC reserves the right to use or let use by its third party commercial partners your personal information (but expressly excluding your name, adress, e-mail and contact data) and non-personal information to help PaperC and its commercial partners to deliver targeted advertisements, promotions and other similar initiatives to you.

If you choose to purchase or otherwise use physical products or digital Content or services by clicking on a third party link provided on the Digital Distribution Service, such third party may collect your personal data for the purpose of completing a transaction. We advise you to check their terms of use and privacy / data protection policies to find out how they are treating your personal information.

We may be provided with confirmation of your transactions with such third parties for market analyses and statistical purposes and, in some instances, such confirmation may include your personal information.

PaperC will not accept any liability for external links to other websites. PaperC has no influence on the form or content of other websites. Thus, PaperC cannot monitor the way the owners of linked websites treat their data; i.e. this data protection declaration and liability of PaperC does not extend to the offerings/products of third parties.

 

 

Circulation of data to third parties

 

Notwithstanding the aforesaid usages of data and if not otherwise stated herein, PaperC does not pass any data on to any third party without the consent of the user. In order to handle payments, PaperC works with service providers and in consequence data will be circulated for the purpose of processing the order and payment. PaperC reserves the right to pass on defined, summarised (aggregated) non-personal data to third-party service providers in an anonymous form. This includes information that PaperC captures regarding individual users and summarises in groups to prevent them from being attributed to users who are identifiable individually or reflects their behaviour in connection with use of the Digital Distribution Service.

 

Right for disclosure of stored data

 

According to the Bundesdatenschutzgesetz any user has got the right to be disclosed his data stored and has got the right to demand PaperC to delete, lock or correct those data. PaperC use the Google Analytics web analysis service of Google Inc.

 

As part of the Digital Distribution Service under URL http://paperc.com analysis of use of the offering takes place using the Google Analytics product. Google Analytics is a web analysis service provided by Google Inc. (Google) that uses cookies. The information obtained by the cookie on your use of the Digital Distribution Service (including your IP address) will be sent to a USA-based Google server in the USA and stored there. Google will use this information in order to analyse your use of the Digital Distribution Service, to compile reports on use of the website and to provide further services connected with use of the website and the Internet. If applicable, Google will also pass this information on to third parties if this is required by law or to the extent that third parties process this data on the instruction of and on behalf of Google. Google will not in any circumstances link your IP address to other data. SSL (security standard)

 

PaperC uses the most recent security standard “Secure Socket Layers” (SSL) for all data that you enter when visiting the pages of the Digital Distribution Service of PaperC. Your data will be encrypted when it is transmitted.

 

All information relevant in terms of data protection will be filed in a secure data base.

 

The use of cookies

 

PaperC uses what are known as cookies; these are text files that are stored on your computer and enable an analysis of the way the User uses the website. This technology enables PaperC to recognise you as the User of the Digital Distribution Service and offer you customised services. A prerequisite for use of the Digital Distribution Service is that the system you use accepts cookies. They serve to check your log-in status and to recognise you when you access your user account.

 

Deletion of data

 

Your data will be stored by PaperC no longer than the maximum period permitted by statutory law. This does not entail any obligation to store data. However, the User has the possibility of cancelling storage by means of an objection sent to PaperC. The User acknowledges that some personal information, in particular any information shared by the User with others, can not be deleted. The objection requires text form (e-mail, Fax, letter). In the case of deletion of the user data, in particular access by the User to the “My library” feature of the Digital Distribution Service and the data stored there will not be possible. Data relating to billing that is subject to statutory storage requirements will not be affected by any objection by the User and will be deleted after the statutory periods have expired.
